1. Agreement to Terms

By enrolling in music lessons with Adkins Music Lessons ("we," "us," "our," or "Company") and accessing adkinsmusiclessons.com (the "Site"), you agree to be bound by these Terms of Service. If you do not agree, you may not enroll in our services or use our Site.

2. Description of Services

Adkins Music Lessons provides private music instruction at four locations in the Omaha, Nebraska metropolitan area: Omaha, Bellevue, Elkhorn, and Gretna. Our services include private lessons in piano, guitar, vocals, drums, violin, flute, and other instruments for students of all ages and skill levels. Curriculum, lesson length, and scheduling are determined by mutual agreement between the student (or parent/guardian) and Adkins Music Lessons.

3. Enrollment and Payment

3.1 Enrollment

Enrollment begins when a student (or parent/guardian of a minor) completes our online enrollment form and receives confirmation from us. Information provided during enrollment must be accurate and complete.

3.2 Payment Terms

Payment terms, rates, and scheduling policies are communicated upon enrollment confirmation. You are responsible for ensuring payment is made according to the agreed-upon schedule.

3.3 Late Payments

If payment becomes overdue, we may suspend lessons until payment is received; continued non-payment may result in termination of services.

4. Cancellations and Refunds

Cancellation policies, including notice periods, refund procedures, and any applicable fees, are provided upon enrollment. Contact your lesson studio directly for specifics.

5. Student Responsibilities

5.1 Punctuality

Students are expected to arrive on time; late arrivals may result in a shortened lesson.

5.2 Attendance

Students and parents/guardians should provide advance notice if a student cannot attend a scheduled lesson.

5.3 Conduct

Students are expected to conduct themselves respectfully and professionally. Disruptive behavior or disrespect toward instructors may result in lesson termination.

5.4 Instrument and Materials

Students are responsible for obtaining and maintaining their own instruments and materials unless otherwise agreed in writing. We are not responsible for loss, theft, or damage to student instruments or materials.

6. Parent/Guardian Responsibilities (for Minor Students)

Parents or guardians enrolling a minor agree to: provide accurate enrollment information; ensure the student attends lessons as scheduled; maintain payment per agreed terms; supervise the student's use of our Site and services; ensure access to necessary materials and instruments; support the student's practice between lessons; and notify us of any changes in contact information or circumstances affecting participation.

7. SMS Communications Program

7.1 Program Description

When you enroll or use our enrollment form, you may opt in to SMS from Adkins Enterprises, LLC (DBA Adkins Music Lessons): Transactional Messages (scheduling confirmations, reminders, cancellations, account updates) and, only with separate opt-in, Marketing Messages (promotions, specials, announcements).

7.2 Message Frequency

Frequency varies based on your lessons and enrollment.

7.3 Data Rates & Charges

Standard message and data rates from your mobile carrier apply.

7.4 How to Opt Out

Text "STOP" to any message, or contact support, at any time.

7.5 Support & Questions

Reply "HELP" for support instructions, or contact your lesson location directly (Section 15).

7.6 Consent to SMS Communications

By providing your phone number and opting in on our enrollment form, you explicitly consent to receive SMS from Adkins Enterprises, LLC (DBA Adkins Music Lessons).

8. Intellectual Property

All content, materials, and educational resources provided by Adkins Music Lessons are protected by copyright and intellectual property laws, usable solely for the purpose of music instruction. Unauthorized reproduction or distribution without permission is prohibited.

9. Limitation of Liability

To the fullest extent permitted by law, Adkins Music Lessons is not liable for indirect, incidental, special, consequential, or punitive damages arising from these Terms or your use of our services. We assume no responsibility for loss, theft, or damage to student instruments or personal property at our studios; maintain appropriate insurance for valuable instruments.

10. Termination of Services

We reserve the right to terminate lesson services for non-payment, conduct that violates these terms, disruptive behavior, or circumstances beyond our control. Termination does not relieve outstanding payment obligations.

11. Use of Site

When using our Site, you agree not to violate applicable laws, infringe intellectual property rights, transmit malware, attempt unauthorized access, harass or abuse other users or staff, submit false information, or use automated tools/bots without permission.

12. Changes to Terms

We may update these Terms at any time, posting the updated version and revised "Last Updated" date. Continued use after changes constitutes acceptance.

13. Dispute Resolution

Disputes arising from these Terms or your enrollment are governed by the laws of the State of Nebraska. You agree to resolve disputes through good-faith negotiation first, then mediation or binding arbitration as agreed by both parties.

14. Severability

If any provision of these Terms is found invalid or unenforceable, that provision will be severed and the remaining provisions continue in full force and effect.
